1. Scope of Application

These General Terms and Conditions apply to all contracts concluded between gwando (hereinafter “Provider”) and the customer (hereinafter “Client”) regarding the rental of traditional Bavarian clothing (“Tracht”) and the booking of photo tours.

2. Booking & Conclusion of Contract

2.1. By submitting a booking request, the Client makes a binding offer. The contract is concluded when the Provider sends a booking confirmation via email.

2.2. The Provider reserves the right to decline bookings if the requested clothing sizes or dates are unavailable.

3. Rental of Traditional Clothing

3.1. Handover: The rental items will be delivered to the Client’s hotel/accommodation at the agreed time. The Client must check the items immediately; otherwise, they are considered delivered in perfect condition.

3.2. Care & Usage: The Client agrees to treat the rental items with care. Permanent alterations, washing, or dry-cleaning by the Client are prohibited.

3.3. Return: The Client must return the items (e.g., at hotel reception or to the guide) by the agreed time.

3.4. Late Return: If items are not returned on time, the Provider charges a late fee of 50.00 EUR per day.

4. Photo Tours & Guiding

4.1. Punctuality: The Client is responsible for arriving at the meeting point on time. The guide will wait a maximum of 15 minutes. After this, the tour is considered a “No-Show”.

4.2. Weather: Tours take place in all weather conditions unless safety is at risk.

 

5. Prices, Payment & Deposit

5.1. The total price is due upon booking or as specified on the booking platform.

5.2. Security Deposit: Upon delivery of the outfit, a security deposit of 100.00 EUR per outfit is required.

5.3. Deposit Payment Methods: The deposit can be paid in Cash (EUR), via PayPal, or Alipay.

5.4. ID Check: For security reasons, the Provider reserves the right to photograph the Client’s ID card or passport upon handover. This data will be deleted immediately after the safe return of the items.

5.5. Refund: The deposit will be refunded immediately upon return of the undamaged items. In case of damage or loss, the Provider reserves the right to withhold the deposit partly or fully.

6. Damage & Loss Policy

6.1. Normal Wear: Minor soiling (e.g., sweat, street dust) is included in the rental price.

6.2. Damage: In the event of heavy soiling (e.g., red wine, grease) or damage requiring repair, the repair/cleaning costs will be deducted from the deposit.

6.3. Loss: If the item is lost or stolen, the Client is liable for the full replacement value.

7. Cancellation Policy

To offer maximum flexibility, the following cancellation rules apply:

  • Up to 24 hours before the start: Free cancellation (100% refund).

  • Less than 24 hours or No-Show: 100% cancellation fee (no refund).

8. Liability & Safety Instructions

8.1. General Liability: The Provider is liable for damages caused by intent or gross negligence. Liability for slight negligence is excluded, except for damages resulting from injury to life, body, or health.

8.2. Participation at Own Risk: Participation in the photo tours and the wearing of rental clothing (especially traditional footwear) is exclusively at the Client’s own risk. The Client is aware that walking tours in Munich may involve uneven surfaces (cobblestones), traffic, and other urban hazards.

8.3. Compliance with Instructions: The Client agrees to follow the safety instructions of the guide at all times. The Provider is not liable for accidents caused by the Client’s failure to follow instructions or traffic regulations.

8.4. Personal Belongings: The Provider is not liable for loss or damage to personal items (cameras, phones, bags) carried during the tour or left in the rental clothing.

9. Jurisdiction

German law applies. Place of jurisdiction is Munich.
